Participant Agreement and Release
I, the “Releasing Party,” have been informed and understand that there is always some unavoidable risk of injury involved when working with animals, either to the animal, the person, or to property. I acknowledge that dogs can be inherently difficult to control and other dogs present at events may not be under control at all times resulting in the possibility of injury to myself, my dog, my family members, or third parties.
In-Person Event Participants - I hereby accept and assume, without reservation, all risks, known or unknown, and all responsibility for injury, losses, and damages associated with my participation in Lark Canine Services (“Lark Canine Services”) classes or events, including, but not limited to the risks of any and all injuries to myself, my dog and any of my family members who may participate with me and the risk that my dog may cause injury to other persons and/or dogs while at events.
As consideration for participating in Lark Canine Services classes and/or events, I, for myself, my heirs, executors, administrators, legal representatives, successors, and assigns hereby forever release, discharge, and agree not to sue Lark Canine Services, its directors, agents, officers, volunteers, employees, heirs, successors, and assigns from any and all liability, claims, demands, losses, including negligence, breach of warranty, breach of contract, and all other causes of action which may arise from my participation in Lark Canine Services training and/or events. I agree to indemnify, defend, and hold harmless Lark Canine Services from any and all injuries, losses, claims, and damages to any person or persons of any nature whatsoever, including claims arising from Lark Canine Service’s own negligence, and all costs associated therewith, including attorney’s fees, court costs, and consultant fees, arising from my participation in Lark Canine Service training and/or events.
I agree to abide by any Lark Canine Services rules and regulations. I take it upon myself to ask questions and use my own common sense. I understand that I do not have to participate in any part of a class or event with my dog if I do not feel comfortable doing so. I have read the requirements for the course I am registering for and agree that my dog meets the requirements, including any pre-requisite level of training and health requirements. Suppose my dog becomes injured or ill during a Lark Canine Services course or event. In that case, I will stop all activities and training associated with the course or event until my dog has clearance from a vet to resume normal activities. If training a puppy, I will take special care to avoid repetitive moments or any other activities that may harm the long-term health of my dog.
I hereby agree that any claims and/or causes of action, including interpretation of this Agreement or otherwise, must be brought in the Superior Court of New York, Monroe County regardless of where any alleged cause of action arises. Any and all claims are to be governed by New York Law. I further agree that this Agreement shall not be construed for any purpose against the drafter. I hereby agree that this Agreement is legally binding and supersedes any other agreement, written or oral, with respect to the terms governed by this Agreement. Should any provision of this Agreement be determined to be unenforceable, the remaining provisions shall remain in full force and effect.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND RELEASE AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS HEREIN. I AGREE THAT I HAVE SUFFICIENT INFORMATION AND HAVE BEEN GIVEN SUFFICIENT TIME TO ASSESS THE POTENTIAL DEGREE OF RISKS AND INJURIES. I UNDERSTAND THAT BY SIGNING THIS AGREEMENT AND RELEASE I AM GIVING UP SUBSTANTIAL RIGHTS AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I UNDERSTAND THIS AGREEMENT IS A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY AND I HEREBY AGREE TO SAID RELEASES.
No Guarantee of Results
I recognize that the role I play in my dog’s learning process is integral to achieving the desired results. I acknowledge and agree that there is no guarantee that my dog will achieve the desired level of training, despite the best efforts of Lark Canine Services and Ashley Goltermann and I further understand that the recommendation of any other product or service is not a guarantee of satisfaction with that product or service.
Consent to be Recorded
I hereby consent to myself, my dog, any family members or third parties present, and my property that appears on camera is the subject of the photographs and/or audiovisual recordings and authorize Lark Canine Services and Ashley Goltermann to cause the same to be exhibited for course material or marketing tools as still photographs, video, or other similar media. I also agree that my name, my dog's name and/or information about my dog including breed, other AKC titles or events I participate in may be shared for course material or marketing purposes.
Refund Policy for Classes
Payments for classes and events are non-refundable, however may be used as a credit in certain circumstances. We suggest you read the information and description carefully before making your purchase. If you have additional questions on the materials to be covered please contact larkcanineservices@gmail.com PRIOR to purchasing so I may help determine if the topic is suitable for your needs.
All courses must be completed within 12 weeks beginning on the date of their membership is approved for on demand classes or their first zoom meeting for live classes. If the lessons are not completed within this time, it will be at the discretion of Jennifer Hollis to determine if the reason for the delay was warranted. Clients that wish to extend their end training date, must submit a written statement requesting a delay, including the reason for the delay, and the proposed date to resume training prior to the end of the 12 weeks. Clients must receive a written statement, from Jennifer Hollis permitting them to extend their training end date prior to the end of the 12 week period. Without a written statement permitting the extension of the training period or credit for a future training course, the course would be considered forfeited and refunds will not be permitted nor credit issued.
Make-up, rescheduled and missed classes are at the discretion of Lark Canine Services.
